Tribunal Justification to amend Claim Forms

The Employment Appeal Tribunal has recently ruled in the case of Prakesh v Wolverhampton City Council that it is permissible to make an amendment to a claim form if appropriate instead of requiring the claimant to issue a second originating application.

Prior to this decision it was necessary under the Rules of the Supreme Court for a claimant to issue a second claim form if they wanted to either add or substitute a cause of action that was not available
when the originating application was presented and then apply to have the two cases heard together.
