Covert Recordings

In a recent Employment Appeal Tribunal decision, Chairman & Governors of Amwell View School v Dogherty, it was judged that a covert recording of disciplinary proceedings (by the employee concerned) could be taken into consideration and used as evidence.

Surprising as this decision may be, the Support Line recommend that employers continue to turn down requests for disciplinary proceedings to be recorded and to be vigilant if they feel this request is not being complied with.
